Shipping Protection Terms of Use

Thank you for choosing Speak Easy Hair Extensions. We understand that your hair extensions are a valuable investment in your beauty and confidence. Our Shipping Protection service is designed to provide you with peace of mind throughout the delivery process.

These Shipping Protection Terms of Use ("Terms") govern the optional Shipping Protection service offered by Speak Easy Hair Extensions ("we," "us," or "our"). By purchasing Shipping Protection at checkout, you agree to be bound by these Terms.

1. What is Covered

When you purchase Shipping Protection, coverage is provided for the following circumstances:

Lost Packages During Transit: If your order is confirmed lost by the shipping carrier while in transit to your delivery address, Shipping Protection covers the replacement or refund of your order.

Damaged Products Received During Delivery: If your hair extensions or other products arrive damaged due to mishandling during shipping, Shipping Protection covers the replacement or refund of the affected items. You must provide photographic evidence of the damage to the packaging and products.

Stolen Packages After Confirmed Delivery: If your package is marked as delivered by the carrier but you did not receive it, and you have reason to believe it was stolen from your delivery location, Shipping Protection may cover the replacement or refund. A police report may be required for claims exceeding $500 USD.

Missing Items from an Order: If your delivered package is missing one or more items that were included in your original order confirmation, Shipping Protection covers the replacement or refund of the missing items.

2. Eligibility Requirements

To be eligible for Shipping Protection coverage, all of the following requirements must be met:

Purchase at Checkout: Shipping Protection must be selected and purchased at the time you complete your order checkout. It cannot be added retroactively after an order has been placed.

U.S. Deliveries Only: Coverage is available exclusively for orders shipped to addresses within the United States and its territories. International shipments are not eligible for Shipping Protection at this time.

Order Value Limitation: The total value of your order, including all products and applicable taxes, must not exceed $2,000 USD. Orders exceeding this amount are not eligible for Shipping Protection coverage.

Claim Submission Deadlines: Claims must be submitted within the following timeframes:

  • For lost packages: within 15 business days after the last carrier tracking update
  • For damaged items: within 5 business days of delivery
  • For stolen packages: within 10 business days of confirmed delivery
  • For missing items: within 5 business days of delivery

Supporting Documentation: You must provide all requested documentation to support your claim, including but not limited to order confirmation, tracking information, photographs of damage, police reports (when applicable), and any other information reasonably requested by Speak Easy Hair Extensions.

3. Filing a Claim

To file a Shipping Protection claim, please contact our Customer Care team at support@speakeasyhairextensions.com or via Instagram @speakeasyhairextension during our business hours (Monday–Friday, 9:00 AM–5:00 PM EST).

When filing a claim, you must provide the following information:

Order Number: Your complete order number from your order confirmation email.

Tracking Information: The tracking number and carrier information for your shipment.

Description of Issue: A detailed description of the problem, including dates, circumstances, and any relevant details.

Photographic Evidence: For damaged shipments, clear photographs showing:

  • The exterior packaging and any visible damage
  • The interior packaging materials
  • The damaged product(s) from multiple angles
  • Any packing slips or documentation included in the package

Police Report: For stolen package claims exceeding $500 USD, a copy of the police report filed with your local law enforcement agency.

Claim Review Process: All claims are reviewed by Speak Easy Hair Extensions in its sole discretion. We reserve the right to request additional information, conduct investigations with shipping carriers, and make final determinations regarding claim approval or denial. Our team typically reviews and responds to claims within 5–7 business days of receiving all required documentation.

Speak Easy Hair Extensions reserves the right to deny claims that do not meet the eligibility requirements outlined in these Terms or that lack sufficient supporting documentation.

4. What is Not Covered

Shipping Protection does not cover the following circumstances:

Incorrect Shipping Addresses: Claims resulting from packages delivered to an incorrect address that was provided by the customer at checkout. Please carefully verify your shipping address before completing your purchase.

Refused Deliveries: Packages that are refused by the recipient or returned to sender due to customer action or inaction.

Delays and Force Majeure Events: Shipping delays caused by circumstances beyond Speak Easy Hair Extensions' reasonable control, including but not limited to:

  • Severe weather conditions, natural disasters, or acts of God
  • Carrier disruptions, strikes, or service interruptions
  • Customs delays or international shipping complications
  • Pandemics, civil unrest, or government actions
  • Any other events beyond our reasonable control

Post-Delivery Damage: Damage occurring after successful delivery, including damage caused by:

  • Customer misuse, mishandling, or improper application
  • Neglect or failure to follow care instructions
  • Improper storage conditions
  • Exposure to excessive heat, chemicals, or other damaging elements

Late Claims: Claims submitted outside the required deadlines specified in Section 2 of these Terms.

Fraudulent Claims: Any claim determined to be fraudulent, misleading, or made in bad faith. Speak Easy Hair Extensions reserves the right to pursue legal action against individuals who submit fraudulent claims.

5. Approved Claims

If your Shipping Protection claim is approved, Speak Easy Hair Extensions will provide a resolution in its sole discretion, which may include:

Replacement Product: We may ship a replacement of the affected product(s) at no additional cost to you. Replacement products will be of the same type, color, and specifications as your original order, subject to availability.

Refund: We may issue a refund for the purchase price of the affected item(s). Refunds will be processed to your original payment method and are limited to the actual purchase price of the product(s) covered by the claim.

Important Limitations:

Refunds are limited to the purchase price of the affected item(s) only and do not include shipping costs, taxes, or other fees unless required by applicable law.

Shipping Protection fees are non-refundable in all circumstances, including approved claims.

The method of resolution (replacement or refund) is determined by Speak Easy Hair Extensions in its sole discretion based on product availability, claim circumstances, and other relevant factors.

6. Limitation of Liability

Maximum Liability: Speak Easy Hair Extensions' maximum liability under these Shipping Protection Terms is strictly limited to the lesser of:

(a) The purchase price of the affected item(s) covered by an approved claim; or

(b) Two Thousand Dollars ($2,000 USD)

Exclusion of Damages: To the maximum extent permitted by applicable law, Speak Easy Hair Extensions shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages arising from or related to Shipping Protection, including but not limited to:

- Lost profits or business opportunities

- Loss of use or enjoyment

- Emotional distress or inconvenience

- Costs of substitute products or services

- Any other damages beyond the replacement or refund of the affected product(s)

This limitation of liability applies regardless of the legal theory upon which any claim is based, including breach of contract, negligence, strict liability, or any other theory.

7. Not Insurance

Important Notice: Shipping Protection is a contractual service agreement provided by Speak Easy Hair Extensions and is not insurance.

Speak Easy Hair Extensions is not an insurance company, is not licensed as an insurer, and does not provide insurance coverage of any kind. Shipping Protection is a voluntary service that provides certain protections as outlined in these Terms, subject to the limitations and exclusions described herein.

By purchasing Shipping Protection, you acknowledge and agree that you are entering into a contractual service agreement with Speak Easy Hair Extensions and not purchasing an insurance policy.

9. Changes to These Terms

Speak Easy Hair Extensions reserves the right to modify, amend, or update these Shipping Protection Terms of Use at any time, in its sole discretion, without prior notice.

Any changes to these Terms will become effective immediately upon posting the updated Terms to our website at speakeasyhairextensions.com. The "Effective Date" at the top of these Terms will be updated to reflect the date of the most recent revision.

Your continued purchase of Shipping Protection after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.

Changes to these Terms will apply only to Shipping Protection purchased after the effective date of the changes. Shipping Protection purchased prior to any changes will be governed by the Terms in effect at the time of purchase.

10. General Provisions

Entire Agreement: These Terms, together with our general Terms of Service and Privacy Policy, constitute the entire agreement between you and Speak Easy Hair Extensions regarding Shipping Protection and supersede all prior agreements, understandings, and communications.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Speak Easy Hair Extensions is registered, without regard to conflict of law principles.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Speak Easy Hair Extensions may assign these Terms at any time without notice.
